Operator: Digitsy Inc. (“we,” “us,” or “Distancer.ai”), a California corporation with its principal place of business at 21010 Anza Ave #28, Torrance, California 90503.
We respect your privacy. This Privacy Policy explains how we collect, use, share, and protect your personal information when you use Distancer.ai (the “Platform”), create or operate a Business Project (in sandbox or production), or purchase from any Business Project. It is consistent with and supplements our Terms of Service and is incorporated into those Terms by reference.
Plain-language summary (non-binding): Business Owners (U.S. entities/organizations only) control their own data and their Customers’ data. We collect only what we need to run the AI platform, provide hosting/payments, and improve our service (including anonymized AI training). You start free in the sandbox with minimal data collection. Production requires subscription and Stripe verification. We do not sell your data.
1. Definitions
- Business Owner: A United States entity (corporation, LLC, partnership, sole proprietorship, or other organization organized under the laws of a U.S. state with its principal place of business and operations in the United States) that creates and operates a Business Project, whether through an individual or Organization Account.
- Customer: Any individual or entity (located anywhere permitted by applicable law), whether acting personally or through an Organization Account, who purchases goods, services, subscriptions, or licenses from a Business Project.
- Business Project: An online and/or in-person business presence that can be built and/or modified automatically by our AI and/or manually by the Business Owner, including (but not limited to) storefront, payment processing, in-person and online services, remote video calls, inventory management, a computer App Store for app license management, organization user and user permission management, related tools, and any other parts, tools, features, or services that Digitsy Inc. may add or develop from time to time as part of our ongoing expansion of the Platform.
- Sandbox Environment: The free testing environment where Business Projects can be built and tested without being visible or available to the public.
- Production Environment: The live, public-facing version of a Business Project.
- Organization Account: An Account registered on behalf of a corporation, LLC, partnership, or other legal entity.
- Materials: Any content, products, images, text, data, or settings you upload or provide.
- Personal Information: Any information that identifies or could reasonably identify you or your organization.
2. Information We Collect
We collect different information depending on your role and whether you are in the Sandbox or Production Environment.
From Business Owners (U.S. entities/organizations only)
- Account and contact information (legal name/entity name, U.S. business address, phone, email, proof of authority for Organization Accounts).
- Business Project content and Materials (descriptions, inventory data, app licenses, user/permission settings, in-person or remote service configurations).
- Payment and subscription information (processed by Stripe).
- Stripe identity verification data (KYC/AML information required to publish to Production).
- Usage data (how you interact with the AI builder and dashboard).
- In Sandbox: Limited to the above for testing only; no public exposure.
From Customers
- Purchase information (name, shipping/billing address, email, phone, payment details – processed by the Business Owner’s Stripe integration).
- Interaction data (reviews, support messages, video call participation if enabled by the Business Owner).
- We do not directly collect Customer data except as necessary to facilitate payments or Platform functionality; the Business Owner is the data controller for sales-related Customer data.
Automatically Collected (All Users)
- Device and browser information (IP address, device type, operating system, browser).
- Usage and analytics data (pages viewed, features used, interactions).
- Cookies and similar technologies (see Section 6).
Sensitive Information
We may collect government-issued identifiers or precise geolocation only when required for Stripe verification or service delivery, and only with appropriate safeguards.
We do not collect or require sensitive personal information (race, religion, health data, etc.) unless voluntarily provided and necessary for a specific Business Project feature.
3. How We Use Your Information
- Provide and improve the Platform and AI features (including using your Materials and anonymized Business Project data to train and enhance our AI).
- Enable sandbox testing and Production publishing (including Stripe identity verification).
- Process subscriptions and payments.
- Support organization user/permission management and Business Project operations.
- Communicate with you (account notices, updates).
- Detect fraud, enforce Terms of Service, and comply with legal obligations.
- Generate aggregated/anonymized analytics and improve new business types and features.
We do not use your data for marketing without consent.
4. How We Share Your Information
We share only as necessary:
- Service Providers: Stripe (for payments and identity verification), cloud hosting, analytics vendors, and other subprocessors under strict data processing agreements.
- Business Owners and Customers: Limited transaction data is shared between Business Owner and Customer to complete sales (we are not the seller).
- Legal Requirements: To comply with law, respond to valid requests, or protect rights/safety.
- Affiliates: Within Digitsy Inc for operational purposes.
We do not sell personal information. Business Owners remain responsible for their own Customer data privacy obligations (they control their Business Project’s privacy settings and terms).
Anonymized or aggregated data may be used publicly or shared for research/marketing of the Platform.
5. AI and Machine Learning
We use machine learning and AI techniques to generate and improve Business Projects. Your Materials and Business Project data (anonymized where required by law) may be used to train and enhance our AI, which consists of platform code and any AI technology or models developed by Digitsy Inc. and/or AI models and technology licensed from third-party providers. This helps us create better tools for all users. You grant us this right under the Terms of Service. AI outputs are not guaranteed; you remain responsible for reviewing them.
6. Cookies and Tracking Technologies
We use essential cookies for site functionality, analytics cookies (to improve the Platform), and functional cookies (for preferences). You may control cookies via browser settings. We do not use tracking for cross-site advertising.
7. Data Retention
We retain personal information only as long as necessary:
- Sandbox data: Deleted or anonymized shortly after testing ends.
- Production data: Retained while your subscription is active plus 30 days after cancellation (or longer if required for legal/tax reasons).
- Stripe verification data: Retained as required by Stripe and applicable law.
- Anonymized AI training data: Retained indefinitely.
8. Security
We use industry-standard technical and organizational measures (encryption, access controls, audits). No system is 100% secure; we cannot guarantee absolute security. You must secure your Account credentials.
9. Your Rights
California Residents (CCPA/CPRA) and All U.S. Business Owners: You have the right to:
- Know what personal information we collected, used, and shared.
- Correct inaccurate information.
- Delete your personal information (subject to exceptions).
- Opt out of any “sales” (we do not sell data).
- Limit use of sensitive personal information.
- Not be discriminated against for exercising rights.
All Users: You may also request access, correction, deletion, or portability by contacting us. For Customer data controlled by a Business Owner, contact that Business Owner directly.
We will verify your identity before processing requests. Appeals are available if a request is denied.
10. Children’s Privacy
The Platform is for users 18 and older (or the age of majority). We do not knowingly collect personal information from children under 18. If we learn we have such data, we will delete it.
11. International Transfers
Because Business Owners must be U.S. entities, most data is processed in the United States. For Customers outside the U.S., data may be transferred to and processed in the U.S. subject to appropriate safeguards (standard contractual clauses or equivalent where required).
12. Changes to This Policy
We may update this Privacy Policy. Material changes will be notified via email or Platform banner. Continued use after changes constitutes acceptance. The effective date will be updated.
